PRIVACY POLICY

  1. PURPOSE AND SCOPE

Birch Haven Real Estate, LLC (“Company,” “we,” “us,” or “our”) is committed to protecting the privacy of individuals who visit our website, inquire about our services, or engage with us in connection with real estate sales, or related services (collectively, the “Site” and “Services”). This Privacy Policy describes how we collect, use, share, safeguard, and dispose of the information you provide to us or that we collect about you, and explains your choices regarding that information.

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree, please discontinue use of the Site immediately.

This Privacy Policy is incorporated into and made a part of our Terms of Use.

 

  1. INFORMATION WE COLLECT

We collect two general categories of information: information you provide directly to us, and information collected automatically through your use of the Site.

We use both session cookies (which expire when you close your browser) and persistent cookies (which remain on your device until deleted or expired). We do not link the information stored in cookies to any personally identifiable information you submit while on the Site, unless you are logged into an account.

(e) To improve, maintain, and operate the Site and our Services;

(f) To analyze usage trends and conduct internal research and analytics;

(g) To detect, prevent, and respond to fraud, security incidents, and other harmful or unlawful activity;

(h) To enforce our Terms of Use and other agreements;

(i) To comply with applicable legal obligations, court orders, and governmental requests; and

(j) For any other lawful business purpose disclosed to you at the time of collection or for which you have provided consent.

We will not use your personal information for materially different or incompatible purposes without providing you prior notice and, where required, obtaining your consent.

 

  1. HOW WE SHARE INFORMATION

We do not sell your personal information to third parties for their direct marketing purposes. We may share your information in the following circumstances:

We share information with third-party vendors and service providers who perform services on our behalf, including payment processors, email service providers, data storage providers, analytics providers, and software platforms used in connection with our real estate operations. These service providers are contractually required to protect your information and are prohibited from using it for any purpose other than performing the services we have engaged them to provide.

(b) Real Estate Platforms. We utilize third-party real estate software platforms to manage customer relations. When you interact with these platforms — including creating an account, submitting a payment, or communicating through a portal — your information is also processed by and subject to the privacy policies of those third-party platforms. (c) Business Transactions. In the event of a merger, acquisition, reorganization, sale of assets, or similar corporate transaction, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or use of your information, and any successor entity will be required to honor the terms of this Privacy Policy.

(d) Legal Obligations and Rights. We may disclose your information to government authorities, law enforcement officials, or other third parties when we believe disclosure is necessary to: comply with applicable law, regulation, or legal process (such as a subpoena or court order); protect the rights, property, or safety of our company, our users, or others; detect, prevent, or respond to fraud or illegal activity; or enforce our Terms of Use or other agreements.

(e) With Your Consent or At Your Direction. We may share your information with other third parties when you direct us to do so or when you provide your consent.

(f) Aggregated or De-Identified Data. We may share aggregated or de-identified information that cannot reasonably be used to identify you with third parties for research, analytics, marketing, or other purposes.

 

  1. SMS AND ELECTRONIC COMMUNICATIONS

If you opt into our SMS messaging service, you consent to receive text messages from Birch Haven Real Estate, LLC at the phone number you provide. These messages may include, but are not limited to, listing alerts, showing confirmations, transaction updates, and other communications directly related to our services.

Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any message or by contacting us at Info@BirchHaven.com. Reply HELP for assistance. Consent to receive SMS messages is not a condition of any rental, purchase, or agreement with us.

We will not share your SMS opt-in data or consent status with third parties for purposes unrelated to delivering the service, except as necessary to facilitate message delivery through our telecommunications and platform providers.

By registering on the Site or otherwise providing your contact information, you consent to receive electronic communications from us. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

To opt out of marketing emails, follow the unsubscribe instructions in any marketing email we send, or contact us directly at Info@BirchHaven.com. Please note that even if you opt out of marketing communications, we may still send you transactional or service-related communications.

 

  1. DATA SECURITY

We take reasonable administrative, technical, and physical measures to protect your personal information from unauthorized access, disclosure, alteration, and destruction. Where applicable, personal information transmitted to and from our Site is encrypted using HTTPS/TLS technology.

However, no method of transmission over the Internet or method of electronic storage is completely secure. While we strive to protect your information, we cannot guarantee absolute security. You transmit information to us at your own risk. Once we receive your information, we make commercially reasonable efforts to maintain its security.

In the event of a security breach involving your personal information, we will comply with all applicable Florida and federal notification requirements.

We limit access to personal information to employees, contractors, and service providers who need that information to operate, develop, or improve our services, and who are subject to confidentiality obligations.

 

  1. DATA RETENTION

We retain your personal information for as long as necessary to fulfill the purposes for which it was collected, to provide our services, to comply with our legal obligations, to resolve disputes, and to enforce our agreements. The specific retention period for any category of information depends on the nature of the information, the purpose for which it was collected, and applicable legal requirements.

When personal information is no longer needed, we will delete, de-identify, or otherwise render it inaccessible in a secure manner, including through shredding, incineration, or irretrievable electronic erasure.

 

  1. THIRD-PARTY LINKS

The Site may contain links to third-party websites or services not operated or controlled by us. We provide these links for convenience and informational purposes only. We do not endorse and are not responsible for the content, privacy practices, or data collection practices of any third-party site. We encourage you to review the privacy policy of any third-party site before submitting personal information to it. Your use of third-party sites is at your own risk.

 

  1. CHILDREN’S PRIVACY

The Site is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information without your consent, please contact us at Info@BirchHaven.com. If we learn that we have collected personal information from a child under 13, we will promptly delete that information from our systems.

(a) Access and Correction. You may contact us to request access to, or correction of, the personal information we hold about you. We will use reasonable efforts to accommodate such requests, subject to applicable law.

We will honor deletion requests to the extent permitted by law, except where we are required or permitted to retain your information for legal, regulatory, or legitimate business purposes.

(c) Opt-Out of Marketing. You may opt out of receiving marketing communications from us at any time by following the unsubscribe link in any marketing email, replying STOP to any SMS message, or contacting us directly. Please allow a reasonable period for your opt-out to be processed. Note that even after opting out of marketing, you may continue to receive transactional and service-related communications.

(d) Cookies. You may adjust your browser settings to refuse or delete cookies. Note that doing so may affect the functionality of certain parts of the Site.

(e) To submit any privacy request, please contact us using the information in Section 13 below. We may require you to verify your identity before processing your request.

We reserve the right to modify this Privacy Policy at any time, in our sole discretion. Changes will become effective upon posting the updated policy to the Site, and the Effective Date at the top of this page will be updated accordingly. We will provide reasonable notice of material changes, which may include posting a notice on the Site or sending an email to users who have provided us with an email address. Your continued use of the Site following the posting of any changes constitutes your acceptance of the revised Privacy Policy.

This Privacy Policy is governed by the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising out of or related to this Privacy Policy shall be subject to the exclusive jurisdiction of the state and federal courts sitting in Hillsborough County, Florida.
